Back in November of 2010 Villanova forward JayVaughn Pinkston was involved in an off-campus altercation that would ultimately result in him having to sit out the entire 2010-11 season.
One would think that by this point the issue would have been resolved in the court of law, and all involved would be able to move forward.
But that isn’t the case as Pinkston and attorney James Famiglio have requested that action on his case be postponed. This is the third time that a request has been made in fact.
The reason why? They still haven’t heard back from the county in regards to Pinkston’s application to join the Accelerated Rehabilitative Disposition program.ARD is a probationary program that allows first time offenders to avoid the criminal justice system. Instead, the court orders conditions, such as community service, restitution, or counseling that must be completed during a period of supervision. Participants in the program are not convicted of a crime and can have their arrest record and ARD record expunged 30 days after completion.
It is normally available for non-violent crimes, but the decision whether to offer the program to an individual made by the District Attorney.
With one charge of assault having been dropped, Pinkston still faces charges of simple assault and harassment (two counts) to which he has plead not guilty.
